Alıcı bilgileri, üyelik/satın alma işleminde kaydedilen bilgilerdir.

Madde 2 - Sözleşme Konusu

İşbu sözleşmenin konusu, Alıcı'nın Satıcı'ya ait novv.ai web sitesi ve/veya Novv AI mobil uygulaması üzerinden elektronik ortamda satın aldığı dijital hizmete ilişkin 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği hükümleri gereği tarafların hak ve yükümlülüklerinin belirlenmesidir.

Madde 3 - Hizmet Bilgileri

Novv AI platformu üzerinden sunulan dijital hizmetler:

3.2 Kredi Paketleri (Tek Seferlik)

Her kredi, 1 adet AI destekli profesyonel moda fotoğrafı üretimi için kullanılır. Vergiler ödeme sırasında ülkenize göre hesaplanır.

Madde 4 - Ödeme Şekli

• Ödemeler, güvenli ödeme altyapısı üzerinden gerçekleştirilir
• Kredi ve banka kartı (Visa, Mastercard, American Express) ile ödeme kabul edilir
• Ödeme bilgileri Novv AI tarafından saklanmaz, güvenli ödeme altyapısı üzerinden işlenir
• Fatura bilgileri satın alma işleminden sonra e-posta adresinize gönderilir

Madde 5 - Teslimat

• Novv AI dijital bir hizmettir, fiziksel teslimat yapılmaz
• Satın alınan abonelik ve krediler ödeme onayından hemen sonra hesabınıza tanımlanır
• Dijital teslimat anında gerçekleşir

Madde 6 - Cayma Hakkı

Novv AI hizmeti, dijital içerik niteliğinde olup ödeme onayının ardından anında teslim edilmektedir. Bu nedenle, hizmetin ifasına başlandıktan sonra cayma hakkı bulunmamaktadır.

Ancak aşağıdaki durumlarda iade yapılabilir:

• Ödeme yapılmasına rağmen hizmet hesaba yansımadıysa
• Teknik arıza nedeniyle hizmetten hiç yararlanılamadıysa
• Mükerrer ödeme yapıldıysa

Madde 7 - Genel Hükümler

• Alıcı, satın alma işlemini tamamlamadan önce bu sözleşmenin tüm koşullarını okuduğunu ve kabul ettiğini beyan eder
• Satıcı, hizmet kalitesini artırmak amacıyla fiyat ve hizmet koşullarında değişiklik yapma hakkını saklı tutar
• Alıcı'nın sözleşme koşullarını ihlal etmesi durumunda Satıcı hesabı askıya alabilir veya sonlandırabilir
• Taraflar arasında doğabilecek uyuşmazlıklarda Türkiye Cumhuriyeti yasaları uygulanır

Madde 8 - Yetkili Mahkeme

İşbu sözleşmeden doğan uyuşmazlıklarda, Tüketici Hakem Heyetleri ile Alıcı'nın veya Satıcı'nın yerleşim yerindeki Tüketici Mahkemeleri yetkilidir.

Madde 9 - Yürürlük

Alıcı, satın alma işlemini tamamladığında işbu sözleşmenin tüm koşullarını kabul etmiş sayılır. Sözleşme, satın alma tarihinde yürürlüğe girer.

Article 1 - Parties

Buyer information is the data registered during the membership/purchase process.

Article 2 - Subject of the Agreement

The subject of this agreement is to determine the rights and obligations of the parties in accordance with Consumer Protection Law No. 6502 and Distance Contracts Regulation regarding the digital service purchased by the Buyer electronically through the Seller's novv.ai website and/or Novv AI mobile application.

Article 3 - Service Information

Digital services offered through the Novv AI platform:

3.1 Subscription Plans

3.2 Credit Packages (One-time)

Each credit is used for generating 1 AI-powered professional fashion photograph. Taxes are calculated at checkout based on your location.

Article 4 - Payment Method

• Payments are securely processed through a secure payment infrastructure
• Credit and debit card payments (Visa, Mastercard, American Express) are accepted
• Payment information is not stored by Novv AI; it is processed through a secure payment infrastructure
• Invoice information is sent to your email address after purchase

Article 5 - Delivery

• Novv AI is a digital service; no physical delivery is made
• Purchased subscriptions and credits are assigned to your account immediately after payment confirmation
• Digital delivery is instant

Article 6 - Right of Withdrawal

Novv AI service is of digital content nature and is delivered instantly upon payment confirmation. Therefore, there is no right of withdrawal after the service has begun.

However, refunds may be made in the following cases:

• If the service is not reflected in the account despite payment
• If the service could not be used at all due to technical failure
• If a duplicate payment was made

Article 7 - General Provisions

• The Buyer declares that they have read and accepted all terms of this agreement before completing the purchase
• The Seller reserves the right to change prices and service conditions to improve service quality
• The Seller may suspend or terminate the account if the Buyer violates the agreement conditions
• Turkish Republic laws apply to disputes between the parties

Article 8 - Jurisdiction

Consumer Arbitration Boards and Consumer Courts at the Buyer's or Seller's place of residence are authorized for disputes arising from this agreement.

Article 9 - Effective Date

The Buyer is deemed to have accepted all terms of this agreement upon completing the purchase. The agreement becomes effective on the date of purchase.
